Opening Hours should be enforced – Cashel Council

PLANNING conditions attached to new developments in the town restricting their hours of operation should be strictly enforced, insisted members of Cashel Town Council. Cllr Martin Browne (SF) asked the Town Clerk what bye-laws were in place governing takeaways and restaurants.

PLANNING conditions attached to new developments in the town restricting their hours of operation should be strictly enforced, insisted members of Cashel Town Council. Cllr Martin Browne (SF) asked the Town Clerk what bye-laws were in place governing takeaways and restaurants.

“There is a lot of concern,” he said. “Some nights there is a place open until 3am or 4am.” Cllr Browne asked if the Council has any powers to enforce the conditions attached to the planning permission for such developments. “Can we bring in bye-laws?” he asked.

Town Clerk Marie McGivern said all conditions attached to a planning permission must be complied with, otherwise the town can enact enforcement proceedings. These conditions are specific to each case. Cllr Dan Dillon (Ind) asked: “Who is going to see that these conditions have not been breached? Does a person have to see the conditions being breached? Does there have to be a detailed report? Or is it up to the Council?”
