Legal Advice Sought On Rezoning Issue

TOWN Manager Marcus O’Connor has told Nenagh Town Council that county manager Joe MacGrath had sought legal advice with specific regard to the zoning of a parcel of land in the Nenagh and Environs Draft Development Plan (2013-19).

Following a decision made at a meeting of North Tipperary County Council with specific regard to a parcel of land bordering Nenagh, but under the remit of the county council, Mr MacGrath had sought legal advice on the matter and circulated that legal advice to the councillors.

The Tipperary Star understands that the legal advice sought by the manager was whether or not the land could be removed from the Nenagh Draft Development Plan and the plan subsequently amended and put on public display. The Star also understands that that advice has been received.

“The County Manager will now make a decision based on the legal position and a revised manager’s report will then be published,” Mr O’Connor told the town council’s September meeting.

“You adopted the manager’s report and there is no issue with any of those decisions or recommendations. The parcel of land is in the county area,” Mr O’Connor added.

Fine Gael’s Tom Moylan said that he “did not want the message going out from here that legal advice was sought because of the actions of this town council”.

Cllr Conor Delaney said that there were a “number of possible legal ramifications” to the decision.

“We all have to take a step back and see what action the county manager is prepared to take,” Cllr Delaney said.

Independent Cllr Hughie McGrath, who is also a county councillor, explained that he had the “people” and the “community” at heart when he made his decision with specific regard to planning issues.

Sinn Féin’s Cllr Séamus Morris indicated that “we did not make this decision lightly”.

“The goalposts were changed on us too many times,” Cllr Morris said, adding: “We felt exasperated”.

“We did what we felt was right,” Cllr Morris said. “We did everything in our power to do the right thing and to be honest about it.”
